JATIMTIMES - Presiden RI Prabowo Subianto resmi menandatangani Undang-Undang Nomor 5 Tahun 2026 tentang Kepolisian Negara Republik Indonesia (Polri), yang merupakan perubahan ketiga atas Undang-Undang Nomor 2 Tahun 2002 tentang Polri.
Berdasarkan informasi yang dipublikasikan melalui laman Jaringan Dokumentasi dan Informasi Hukum (JDIH) Sekretariat Negara, aturan tersebut diteken pada 17 Juni 2026. Sebelumnya, revisi UU Polri telah disahkan dalam rapat paripurna DPR pada Selasa (9/6/2026) setelah seluruh fraksi menyatakan persetujuan.

Pengesahan dilakukan dalam sidang yang dipimpin Wakil Ketua DPR RI Sufmi Dasco Ahmad. Meski telah resmi menjadi undang-undang, beleid ini masih menuai perhatian dan kritik dari berbagai kalangan.
Isi Revisi UU Polri Revisi UU Polri membawa sejumlah perubahan penting, terutama yang berkaitan dengan masa dinas dan pengelolaan sumber daya manusia di lingkungan kepolisian. Berikut beberapa poin utamanya:
• Batas usia pensiun dibedakan berdasarkan jenjang kepangkatan. Anggota berpangkat tamtama dan bintara kini memiliki batas usia pensiun maksimal 59 tahun. Sementara itu, perwira pertama, perwira menengah, hingga perwira tinggi dapat bertugas hingga usia 60 tahun.
• Perwira tinggi bintang empat dapat memperoleh perpanjangan masa dinas. Berdasarkan Pasal 30 ayat (5) huruf c, batas usia pensiun maksimal ditetapkan 60 tahun. Namun, masa dinas tersebut dapat diperpanjang paling lama satu tahun atau disesuaikan dengan kebutuhan organisasi berdasarkan keputusan presiden.
• Jabatan fungsional mengikuti aturan tersendiri. Anggota Polri yang menduduki jabatan fungsional akan mengikuti ketentuan batas usia pensiun sesuai dengan peraturan yang berlaku bagi jabatan fungsional tersebut.
• Anggota dengan keahlian khusus dapat dipertahankan lebih lama. Personel yang memiliki kompetensi tertentu atau dinilai masih sangat dibutuhkan organisasi dapat memperoleh perpanjangan masa dinas sesuai mekanisme yang diatur dalam undang-undang.
• Diatur pula ketentuan peralihan. Revisi UU memuat mekanisme transisi bagi anggota Polri yang mendekati usia pensiun ketika aturan baru mulai berlaku, sehingga penyesuaian dilakukan secara bertahap sesuai ketentuan yang berlaku.
Meski memuat sejumlah perubahan tersebut, revisi UU Polri tidak lepas dari sorotan berbagai pihak, terutama dari kelompok masyarakat sipil yang menilai proses pembentukannya perlu dikaji lebih lanjut.

Salah satunya datang dari dari sejumlah organisasi yang tergabung dalam Koalisi Masyarakat Sipil untuk Reformasi Kepolisian. Koalisi yang beranggotakan KontraS, YLBHI, ICJR, PSHK, LBH Jakarta, LBH Masyarakat, SAFEnet, ICW, AJI Indonesia, Yayasan Kurawal, PBHI, WeSpeakUp, dan organisasi lainnya menilai proses penyusunannya tidak melibatkan partisipasi publik secara bermakna.
Menurut mereka, beberapa ketentuan dalam revisi tersebut dinilai tidak sejalan dengan semangat reformasi kepolisian, termasuk perubahan mengenai batas usia pensiun yang dianggap perlu dikaji lebih mendalam.
Kritik juga disampaikan oleh anggota Gerakan Nurani Bangsa, Laode M. Syarif. Ia menilai proses pembentukan undang-undang di DPR belum sepenuhnya mengakomodasi aspirasi masyarakat.
“Contohnya, revisi Undang-Undang Polri. Itu sama sekali tidak mengakomodasi semua rekomendasi yang diberikan oleh Komisi Reformasi,” ujar Laode.
Dengan telah ditandatanganinya revisi UU Polri oleh Presiden Prabowo Subianto, Undang-Undang Nomor 5 Tahun 2026 kini resmi berlaku sebagai dasar hukum terbaru bagi penyelenggaraan institusi Polri.
Meski demikian, sejumlah ketentuan di dalamnya diperkirakan masih akan menjadi perhatian publik dan memunculkan diskusi lanjutan mengenai arah reformasi kepolisian di Indonesia.
