JATIMTIMES - Pembahasan Rancangan Perubahan Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia (HAM) memasuki fase penting. Dalam uji publik yang digelar di Fakultas Hukum (FH) Universitas Brawijaya (UB), Rabu (17/6/2026) sejumlah isu strategis mengemuka, mulai dari pengakuan hak digital, tanggung jawab korporasi terhadap hak asasi manusia, perlindungan pembela HAM, hingga penguatan mekanisme penanganan pelanggaran HAM berat.
Staf Ahli Bidang Reformasi Birokrasi dan Regulasi Kementerian HAM RI, Prof. Dr. Rumadi Ahmad, M.Ag., mengatakan revisi UU HAM diperlukan karena Undang-Undang Nomor 39 Tahun 1999 dinilai belum sepenuhnya mampu mengakomodasi perkembangan persoalan HAM yang muncul dalam dua dekade terakhir.

Menurut Rumadi, salah satu substansi baru yang diakomodasi dalam rancangan tersebut adalah pengaturan mengenai hak-hak digital. “Karena memang salah satu hal yang menyebabkan kenapa RUU HAM ini perlu dilakukan perubahan, ini karena ada hal-hal baru yang harus masuk dalam undang-undang ini. Misalnya tentang hak-hak digital. Kemudian soal hak-hak yang terkait dengan persoalan business and human rights,” ujarnya.
Selain hak digital, rancangan perubahan UU HAM juga memperluas cakupan tanggung jawab perlindungan HAM dengan menempatkan korporasi sebagai pihak yang memiliki kewajiban menghormati hak asasi manusia. Selama ini, kewajiban tersebut lebih banyak dibebankan kepada negara, sementara aspek tanggung jawab sektor bisnis belum memiliki dasar hukum yang kuat dalam kerangka UU HAM.
Rumadi menjelaskan bahwa penguatan prinsip business and human rights menjadi penting mengingat semakin besarnya pengaruh korporasi dalam berbagai sektor kehidupan masyarakat.
“Memastikan bahwa yang punya kewajiban untuk menghormati hak asasi manusia itu bukan hanya negara, terutama pemerintah, tetapi juga korporasi itu punya kewajiban. Dan ini belum ada jaminan perlindungan hukumnya dalam hak asasi manusia, makanya ini juga kita masukkan,” katanya dalam uji publik yang dihadiri akademisi, mahasiswa, advokat, kelompok masyarakat sipil, dan aparat penegak hukum.
Substansi lain yang mendapat perhatian dalam revisi UU HAM adalah perlindungan terhadap pembela HAM. Dalam rancangan terbaru, pemerintah mengakomodasi usulan berbagai kelompok masyarakat sipil agar terdapat norma khusus yang memberikan perlindungan hukum bagi individu maupun kelompok yang memperjuangkan hak asasi manusia.
“Harus ada norma khusus mengenai perlindungan terhadap pembela HAM, untuk memastikan bahwa mereka bekerja harus ada perlindungan, tidak bisa dituntut secara pidana, tidak bisa dituntut secara perdata, asal kegiatan yang mereka lakukan dengan iktikad baik dan damai,” jelas Rumadi.
Pembahasan juga menyentuh desain kelembagaan HAM nasional. Pemerintah memilih mempertahankan eksistensi lembaga-lembaga HAM yang telah ada, seperti Komnas HAM, Komnas Perempuan, maupun lembaga lainnya. Namun, revisi undang-undang diarahkan untuk memperkuat koordinasi dan integrasi kewenangan antarlembaga.

Dalam rancangan tersebut, kewenangan penyelidikan dan penyidikan kasus HAM berat tetap dipusatkan pada Komnas HAM. Pemerintah juga merancang mekanisme penugasan penyidik Kejaksaan Agung secara ad hoc guna menghindari kebuntuan penanganan perkara yang selama ini kerap terjadi antara tahap penyelidikan dan penuntutan.
“Selama ini dalam sejumlah kasus pelanggaran HAM berat, hasil penyelidikan Komnas HAM sering tidak berlanjut karena dianggap belum memenuhi standar. Sekarang kita ingin menjaga supaya itu tidak terjadi,” ujar Rumadi.
Saat ini, RUU HAM telah menyelesaikan pembahasan pada tingkat Panitia Antarkementerian dan memasuki tahap harmonisasi di Kementerian Hukum. Pemerintah menargetkan proses harmonisasi selesai pada akhir Juli atau awal Agustus 2026 sebelum diserahkan kepada Presiden untuk diteruskan ke DPR.
“Kami punya target akhir Juli atau awal Agustus sudah selesai proses harmonisasinya. Harapan kami di tahun 2026 ini undang-undang ini selesai,” katanya.
Rektor UB, Prof. Widodo, menilai revisi UU HAM menjadi momentum penting untuk memperbarui instrumen perlindungan hak asasi manusia sesuai perkembangan zaman. Menurutnya, potensi pelanggaran HAM kini tidak hanya muncul dalam hubungan antara negara dan warga negara, tetapi juga melibatkan aktor non-negara serta ruang digital.
“Kalau dulu HAM dikaitkan dengan hubungan negara dan masyarakat sipil, sekarang bisa jadi masyarakat dengan korporat. Bisa jadi di dunia nyata, tetapi juga bisa jadi di dunia maya. Sehingga undang-undang tentang HAM ini harus meliputi seluruh perkembangan tersebut,” ujarnya.
