JATIMTIMES - Selain dapat sanksi administratif dan bahkan di-blacklist, para developer perumahan yang tak memiliki perizinan juga berisiko mendapatkan sanksi hukum. Dampaknya, para pengembang akan kesulitan bahkan tak bisa mengurus perizinan selamanya karena di blacklist. Sedangkan jika terkena sanksi hukum, maka bisa dipenjara.

Peringatan tersebut turut disampaikan Sekretaris Dinas Perumahan Kawasan Permukiman dan Cipta Karya (DPKPCK) Kabupaten Malang Johan Dwijo Saputro. "Selain sanksi administratif dan di blacklist, sebenarnya juga ada sanksi hukum bagi para pengembang," tegasnya saat dikonfirmasi JatimTIMES pada kesempatan belum lama ini.

Dijelaskan Johan, sanksi administratif hingga blacklist tersebut menjadi kewenangannya pemerintah. Sedangkan sanksi hukum kewenangannya ada di Aparat Penegak Hukum (APH) termasuk kepolisian. "Terkait hal itu (sanksi hukum, red), nanti APH selaku pihak yang berwajib juga akan memproses secara hukum jika memang perumahan tersebut tanpa izin," tegasnya.

Johan memastikan, jika telah terjerat kasus hukum, maka tidak akan ada toleransi. Yakni sebagaimana sanksi administratif dari pemerintah yang masih diberikan peringatan dan teguran hingga batas waktu yang ditentukan untuk segera mengurus atau melengkapi perizinan. "Kalau dari sanksi hukum, berarti jelas ada pelanggaran yang ditangani oleh APH," imbuhnya.

Dijabarkan Johan, beberapa kasus yang bisa bermuara pada sanksi hukum tersebut salah satunya meliputi developer yang membangun dan memasarkan perumahan namun tidak berizin. Kemudian, developer yang mengetahui bahwa lahan yang digunakan merupakan zona yang tidak diperbolehkan namun tetap dibangun perumahan.

"Kasus semacam itu pasti ada sanksinya, baik secara aturan tata ruang, aturan pertanahan dan lain sebagainya. Seperti itu nantinya pihak berwajib dalam hal ini APH yang akan mengeksekusi masalah itu jika berkaitan secara hukum," pungkasnya.
