JATIMTIMES - Oknum mata elang atau debt collector (DC) yang mengaku dari BFI Finance dilaporkan ke polisi. Ini atas adanya dugaan perampasan sebuah mobil yang sedang terparkir dalam rumah. 

Pelapor adalah Andy Pratomo, warga Mojoklangru Wetan, Surabaya. Dahulunya dia membeli mobil mewah Lexus RX350 nopol B secara tunai (cash) Rp 1,3 miliar. Tapi anehnya itu justru hendak ditarik paksa  dengan dalih tunggakan cicilan.

​Peristiwa traumatis ini bermula pada akhir tahun medio November 2025 lalu. Gerombolan DC merangsek masuk ke kediaman Andy dan mengklaim memiliki surat kuasa dari BFI Finance karena adanya tunggakan lebih dari enam bulan. 

"Saya beli mobil ini cash bulan September di Jakarta. Semua bukti pembayaran, kwitansi, BPKB, hingga faktur asli saya pegang. Tapi mereka ngotot dan berteriak di depan rumah sampai tetangga keluar semua. Kami sekeluarga sangat dipermalukan," kata Andy. 

Namun ketegangan sempat mereda saat kedua belah pihak dibawa ke Polsek Mulyorejo. Di sanalah kebenaran mulai terungkap. Pihak DC datang membawa fotokopi dokumen dan sertifikat fidusia atas nama orang lain, yakni Adi Hosea. 

​Kejanggalan makin fatal saat kepolisian melakukan cross-check. Pada dokumen yang dibawa tertulis kendaraan tersebut bertipe Lexus RX250. Padahal, secara faktual di dunia otomotif, Lexus tidak pernah memproduksi tipe RX250. 

Sementara itu, fisik mobil dan dokumen asli (STNK/BPKB) milik Andy dengan tegas menyatakan tipe RX350. ​"Besoknya kami uji di Samsat Manyar Kertoarjo. Hasilnya telak, pihak Samsat menyatakan fisik dan surat-surat saya sah dan asli," tegas Andy. 

Sementara itu Ronald Talaway selaku  kuasa hukum korban menyatakan bahwa tindakan ini bukan sekadar salah paham, melainkan tindak pidana murni. Ia membidik para pelaku dengan Pasal 448 KUHP Baru tentang perbuatan tidak menyenangkan dan Pasal 17 ayat (1) terkait percobaan tindak pidana. 

​"Pasal 448 KUHP Baru menegaskan bahwa inti dari perbuatan tidak menyenangkan adalah adanya unsur pemaksaan. Bahkan, dalam Pasal 17 ayat (1) disebutkan, setiap percobaan tindak pidana—meskipun tidak berhasil—tetap dapat dipidana," tegasnya.

Menurutnya, meskipun mobil tidak berhasil dibawa, tindakan intimidasi dan paksaan sudah cukup untuk menyeret para pelaku ke jeruji besi ujar Ronald.

​Gerah dengan praktik ilegal ini, Andy tidak hanya menempuh jalur pidana. Ia berencana menggugat secara perdata dan melaporkan kasus ini ke OJK serta Satgas PASTI. "Tuntutan saya tegas: cabut izin usaha leasing tersebut. Ini demi keamanan masyarakat agar tidak ada lagi korban 'surat bodong' atau intimidasi DC di kemudian hari. Saya minta kepolisian melakukan tindakan tegas dan upaya paksa jika mereka terus mangkir," pungkasnya. 

​Sementara itu, kantor BFI Finance di Surabaya saat akan dikonfirmasi oleh awak media salah satu costumer service yang tidak mau disebut namanya  menjawab secara prosedural dan diarahkan untuk menanyakan di kantor manajemen BFI di Bekasi.
